Likewise, the User may, whenever they consider that their data have been processed inappropriately, submit a complaint, claim or request for the obtaining of more information for the exercise of their rights before the Spanish Data Protection Agency (AEPD) (Calle Jorge Juan, 6. 28001 – Madrid. www.agpd.es).

In compliance with the provisions of current legislation on the protection of personal data, you may address INTERCOSTA TRADE SL as Data Controller in order to exercise your rights of access, erasure, rectification, opposition, limitation of processing and portability with respect to the data incorporated in the files under its responsibility. These rights are personal and will be exercised by the data subject, without other limitations than those provided for by applicable legislation. You may, however, have the legal representative of the interested user act when the user is in a situation of incapacity or minority that makes the personal exercise of these rights impossible, provided that there is express representation authorized by the data holder.

The procedure for erasure of data will be possible in the case of deceased holders by their relatives or exercise of the right of access in the event of the death of the data subject.

You may exercise the right of access by request or application addressed to INTERCOSTA TRADE SL as Data Controller, stating in it your identification and the file or files to be consulted. The exercise of this right may be carried out with an annual periodicity, except for a proven legitimate interest. The Security Officer will decide on the access request within a maximum period of thirty days, counted from the receipt of the request.

INTERCOSTA TRADE SL will only deny access when the request is made by a person other than the data subject or when the exercise is contrary to the terms established in current legislation.
If the resolution were favorable, access will be made effective within ten days following notification of it. The information, whatever the support in which it is provided, will be given in a legible and intelligible form, after a clear transcription of the data from the file, if applicable.

The information will include the basic data of the data subject and those resulting from any elaboration or computer process, as well as the origin of the data, the recipients of the same and the specification of the concrete uses and purposes for which the data were stored.

When access to the files reveals that the data of the data subject are inaccurate or incomplete, inadequate or excessive, you may request rectification or, where appropriate, their erasure.

Rectification, erasure and/or opposition will be made effective by the controller within ten days following receipt of the request.

In the event that the File Controller considers that it is not appropriate to grant what is requested by the data subject, it will communicate it stating the reasons and within the period indicated in the previous paragraph.

In cases in which, even though the erasure of the data is appropriate, their physical extinction is not possible, both for technical reasons and because of the computer support used, INTERCOSTA TRADE SL will proceed to block the data, in order to prevent their subsequent use, until their complete elimination from the information systems.
